Server Resources

Any Web Hosting account deemed to be adversely affecting server performance or network integrity may / will be shut down / suspended without prior notice.

Spamming

Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming") is prohibited, regardless of whether or not it overloads a server or disrupts service to SWDSHosting's customers.

Emails

We offer all clients a mail server. The max emails that can be sent out in any single hour is 100 from a domain.  All emails from sent items / deleted items will be deleted 30 days after and inbox's will have emails removed 90 days after the day of the email being received on the server.

System and Network Abuse

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include, without limitation the following: unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network; interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Viruses

Use of SWDSHosting's services or equipment for creating or sending Internet viruses, worms or Trojan horses, or for pinging, flooding or mail bombing, or engaging in denial of service attacks is prohibited. It is also prohibited for any customer to engage in other activity that is intended to disrupt or interfere with, or that results in the disruption of or interference with, the ability of others to effectively use our services and equipment (or any connected network, system, service or equipment) or conduct their business over the Internet.

Adult Content

Pornography and sex-related merchandising are prohibited on our server. This includes sexual content, or direct links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our server or any other server on the Internet. Links to such materials are also prohibited. SWDSHosting will be the sole arbiter as to what constitutes a violation of this provision.

Non Payment and Accounts

We will create your account as soon as payment as been made. This includes any domains ordered or addons for your account.

If payment is not made for services provided then we reserve the right to suspend or even terminate the account dependent on the circumstances.

Cancellations and Refunds

If you take out one of yearly packages we expect you to commit for this period of time. Because of your commitment, we offer a discount on the normal monthly price of our accounts. If you cancel your account within your service period then SWDSHosting will not make any refunds on any unused portions of your account.

While we do not offer refunds for pro-rated service (beyond our 30 day money back guarantee) you have no obligation to continue using our service.

Web Content

Commercial use of web and ftp space is permitted. You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.

You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).

We reserve the right to remove material deemed inappropriate from your web pages, without prior notice.

We do not allow adult, warez or illegal MP3 web sites on our servers.

Database Limits

SWDSHosting does not have a database restriction on size, however we do have a fair usage policy, both database and log file can not exceed 1.5GB, doing so you will be asked to shrink the dbsize/log.

Free Domain Names

Free domain names are fully registered to the user the same way as it would be if the domain name was purchased.  The domain name can not be transfered away from SWDSHosting for the first 12 months. Free domain names TLDs are restricted to .com / .co.uk

 Actions by SWDSHosting

The failure by a customer to meet or follow any of the AUP is grounds for account deactivation. SWDSHosting will be the sole arbiter as to what constitutes a violation of the AUP. SWDSHosting reserves the right to remove any account without prior notice and to refuse service to anyone at any time.

When SWDSHosting becomes aware of an alleged violation of its AUP, we will initiate an investigation. During the investigation, we may restrict a customer's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, we may, at its sole discretion, restrict, suspend, or terminate a customer's web hosting account and/or pursue other civil remedies.

If such violation is a criminal offense, SWDSHosting will notify the appropriate law enforcement authorities of such violation. An unlisted activity may also be a violation of the AUP if it is illegal, irresponsible, or constitutes disruptive use of the Internet.

SWDSHosting will not be responsible for any damages your business may suffer, we make no warranties of any kind, expressed or implied for services we provide. we disclaim any warranter merchantability or fitness for a particular purpose.

This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by SWDSHosting and its employees.
